Lessee Spring High Pty Ltd;
Property Portion of Land - Derby Wharf
Lease Area: 793m2 (comprising land and buildings);
Market Valuation The market valuation was assessed at $35,680 (excluding GST) per annum on 7 August 2009;
Lease Term Five (5) years with a Five (5) year further term;
Rental Lease Area: $13,636.36 (excluding GST) per annum.
Members of the public are invited to make submissions in relation to the proposal.
Submissions should be made in writing to the Chief Executive Officer of the Shire of Derby/West Kimberley (PO Box 94, Derby WA 6728) by 4:00pm Thursday, 8 October 2009.

PLANNING AND DEVELOPMENT ACT 2005 - TOWN PLANNING SCHEME AMENDMENT2nd September 2009 AVAILABLE FOR INSPECTION SHIRE OF DERBY/WEST KIMBERLEY TOWN PLANNING SCHEME No.5 AMENDMENT No.10 Notice is given that the local government of the Shire of Derby/West Kimberley has prepared the abovementioned scheme amendment for the purpose of: 1. Rezoning a 20m wide portion of Edgar Street road reserve, which abuts the west side of Lot 21 Fitzroy Street, Derby from ‘Rural’ to ‘Residential’;
2. Rezoning a 10m wide portion of Brown Street road reserve, which abuts the east side of Lot 21 Fitzroy Street from a Local Scheme Reserve of ‘Local Road’ to ‘Residential’. 3. Rezoning Lot 21 Fitzroy Street, cnr Edgar Street and Brown Street, Derby from ‘Rural’ to ‘Residential’ for the portion of the land shown as residential lots, roads, pedestrian access way and drain reserve in accordance with the endorsed Development Guide Plan for Lot 21 and allocating the following residential density codes to the Residential zoning; - R40 to the proposed Lots 1, 16, 22 and 33.
- R20 to the proposed Lot 11.
- R30 to Lots 7 and 8, Lots 17 and 18, Lots 23 and 24.
- R15 to all other residential lots;
4. Rezoning the portion of Lot 21 Fitzroy Street, Derby which is indicated as public open space on the endorsed Development Guide Plan from a ‘Rural’ zone to the Local Scheme Reserve of ‘Parks and Recreation’. 5. Amend the Scheme Map by removing the delineation of ‘Residential Development Area’ from around the boundary of Lot 21 Fitzroy Street, Derby.
Plans and documents setting out and explaining the scheme amendment have been deposited at Council’s Development Services Office in Loch Street, Derby and will be available for inspection during office hours up to and including Thursday 15th October 2009. Documents may also be viewed on the Council’s Website www.sdwk.wa.gov.au Submissions on the scheme amendment should be made in writing and lodged with the undersigned on or before Friday 16th October 2009.
