The Shire of Derby/West Kimberley Local Elections 2023 Update

Local government elections for the Shire of Derby/West Kimberley will be held on the Saturday 21 October 2023.

Mr Peter McCumstie was elected unopposed as President as he was the only nomination for that position.

Six vacancies for Council remain: four four-year terms and two two-year terms.

There are two two-year terms because one Councillor resigned mid-term, and Mr McCumstie’s election as President meant that he had to vacate his Councillor seat mid-term.

We received six nominations for the six vacancies.

The four candidates with the most votes will win the seats with four-year terms.

The two candidates with the fewest votes will win the seats with two-year terms.

20/09/2023 Wed Issuing of postal election packages is to commence on the date of election notice or as soon as practicable after this day (Reg. 44(2)).  
Commencement of absent voting to be on the date of election notice or as soon as practicable after this day (Reg. 54(2)).  
Commencement of early voting to be on the date of election notice or as soon as practicable after this day (Reg. 59(2)). 
22/09/2023 Fri  The preparation of any consolidated roll under sub-regulation (1) be completed on or before 29th day before election day (Reg. 18(2)).

 Last day for the Returning Officer to give Statewide public notice of the election (LGA 4.64(1)).  
Preferred date: Wednesday 20 September 2023.

  • Looma Community Store verandah from 11-4:00pm.

Absent voting closes at 4:00pm (Reg. 53(2)). 
Issuing of Postal Votes closes at 4:00pm (Reg. 37(3)).  
Remote early voting in the Shire:  

  • Yungngora Community Store verandah from 8:30-11am. 
  • Yakanara Community Store verandah from 2-3:30pm.

 ELECTION DAY – close of poll at 6:00pm (LGA 4.7) 

The Declaration and Notice of Election Result by the Returning will be posted as soon as practicable (LGA 4.77).  

Within 14 days:  Report to Minister. The report relating to an election under section 4.79 is to be provided to the Minister within 14 days after the declaration of the result of the election (Reg. 81).  
Within 28 days:  An invalidity complaint is to be made to a Court of Dispute Returns, constitute by a magistrate, but can only be made within 28 days after notice is given of the result of the election (LGA 4.81(1)).
